Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") form a binding agreement between you ("you" or "User") and the operator of Arcal ("Arcal," "we," "us," or "our"). By creating an account, downloading, installing, or using the Arcal mobile application (the "App") or any related services (collectively, the "Service"), you agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference.

If you do not agree to these Terms, do not use the Service.

Arcal is currently offered as a pre-release/beta product (including via Apple TestFlight) prior to a full App Store launch. Beta versions may be less stable, may change substantially, and may be discontinued at any time without notice.

2. Description of Service

Arcal is a nutrition and fitness tracking application that allows users to:

• Log food intake via camera-based food recognition, barcode scanning, and manual/text search;
• Track body weight and related metrics over time;
• Build and maintain logging "streaks" and unlock achievements;
• Connect with friends, share meals, and exchange messages within the app.

Arcal is a self-tracking and social tool. It is not a medical device, diagnostic tool, or substitute for professional advice (see Section 6).

3. Eligibility and User Accounts

3.1 Age Requirement

You must be at least 16 years old to create an Arcal account or use the Service. If you are under 16, you may not use Arcal. See our Privacy Policy for children's privacy information.

3.2 Account Registration

You may need to create an account using Sign in with Apple, Sign in with Google, or another supported method. You agree to provide accurate information and to keep your login credentials secure. You are responsible for all activity that occurs under your account.

3.3 One Account

Accounts are for individual, personal use. You may not create an account on behalf of another person without authorization, except where a parent/guardian is administering an account for a minor as permitted by these Terms.

4. User-Generated Content

"User Content" means any content you submit, post, or share through the Service, including food photos, logged meals, weight entries, chat messages, profile information, and any other material you upload.

4.1 Your Responsibility

You are solely responsible for your User Content. Do not post content that is unlawful, harassing, abusive, hateful, sexually explicit, infringing, or that violates another person's privacy (including sharing someone else's information without consent).

4.2 License to Us

You retain ownership of your User Content. By submitting User Content, you grant Arcal a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, reproduce, display, and distribute that content solely as necessary to operate, provide, and improve the Service (for example, showing a shared meal to a friend you've connected with, or displaying it back to you).

4.3 Sharing With Friends

Certain content (e.g., shared meals, achievements, chat messages) may be visible to other users you connect with as "friends" within the app. You are responsible for managing your own friend connections and understanding that content shared with a friend is visible to that friend. Do not share content you don't want another user to see.

4.4 Moderation

We may, but are not obligated to, monitor, review, remove, or restrict access to User Content or accounts that violate these Terms, at our discretion and without prior notice.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose;
• Harass, bully, or impersonate another user;
• Upload malware or attempt to interfere with the Service's operation or security;
• Scrape, reverse-engineer, or attempt to extract source code or underlying data from the App, except as permitted by applicable law;
• Use the Service to promote disordered eating, extreme caloric restriction, or other harmful behaviors directed at other users;
• Circumvent any access, rate, or usage limits.

6. Health and Nutrition Disclaimer

Arcal is not a medical service and does not provide medical advice.

• Nutritional information (including data sourced from food databases and barcode/camera recognition) is provided for informational and tracking purposes only and may be inaccurate, incomplete, or estimated.
• Weight, calorie, and other metrics displayed in the app are self-reported or estimated and should not be relied upon for medical, diagnostic, or treatment decisions.
• Arcal is not intended to diagnose, treat, cure, or prevent any disease, including eating disorders, obesity, diabetes, or other health conditions.
• Always consult a qualified physician, registered dietitian, or other healthcare professional before making changes to your diet, exercise, or health regimen, especially if you have or suspect you may have a medical condition, including disordered eating.
• If you are experiencing symptoms of an eating disorder, please contact a healthcare provider or a crisis resource (e.g., in the U.S., the National Eating Disorders Association helpline).

Use of calorie, weight, and streak-tracking features is at your own risk. We are not liable for any health outcome resulting from your use of, or reliance on, the Service.

7. Third-Party Services

The Service relies on and integrates with third-party providers, including but not limited to:

• Supabase (backend infrastructure, database, and authentication);
• Open Food Facts (open food product database used for barcode/nutrition lookups);
• Apple (Sign in with Apple, push notifications, App Store);
• Google (Sign in with Google);
• Push notification delivery services.

These third parties have their own terms and privacy practices, which we encourage you to review. We are not responsible for the accuracy, availability, or practices of third-party services, including the accuracy of nutrition data sourced from open/community-maintained databases like Open Food Facts.

8. Intellectual Property

The Arcal name, logo, App design, and underlying software are owned by us or our licensors and protected by intellectual property laws. Except for the limited license to use the App as intended, these Terms do not grant you any rights to our trademarks, logos, or proprietary technology.

9. Subscriptions and Purchases

Arcal offers a paid subscription (monthly or annual billing) that unlocks the full app. Subscription purchases are processed through the Apple App Store and governed by Apple's applicable terms and your Apple ID payment settings. Pricing is shown in the app before purchase and set through App Store Connect; we do not display or process payment details ourselves. Subscriptions renew automatically unless canceled through your Apple ID account settings at least 24 hours before the end of the current period.

10. Termination

You may stop using the Service and delete your account at any time (see Privacy Policy for deletion process). We may suspend or terminate your account if you violate these Terms, misuse the Service, or if required by law, App Store policy, or to protect other users. Upon termination, your right to use the Service ends immediately; certain provisions of these Terms (e.g., Sections 6, 8, 11, 12) survive termination.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. AS A PRE-LAUNCH/BETA PRODUCT, THE SERVICE MAY CONTAIN BUGS, DATA LOSS, OR UNEXPECTED BEHAVIOR.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARCAL AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD $50.

Some jurisdictions do not allow certain liability limitations, so some of the above may not apply to you.

13. Indemnification

You agree to indemnify and hold harmless Arcal and its operators from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms or your User Content.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will provide notice (e.g., in-app notice or update to the "Effective Date" above). Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

15. Governing Law and Disputes

These Terms are governed by the laws of Switzerland, without regard to conflict-of-law principles. Any disputes arising from these Terms or the Service shall be resolved in the competent courts of Switzerland, and you consent to personal jurisdiction there.

16. Miscellaneous

• Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the Service.
• Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
• No Waiver: Our failure to enforce any provision is not a waiver of that provision.
• Assignment: We may assign these Terms in connection with a merger, acquisition, or sale of assets. You may not assign your rights under these Terms without our consent.
